About the Missouri Legal System

Missouri has two federal courts: a state supreme and a state court. There are also trial courts with limited and general jurisdiction.

Missouri's state judges are largely selected by merit selection and through the assisted appointment process. The Missouri Plan, which was adopted in 1940 as the first state to implement merit selection, has been used as a model by 34 other states. If they want to serve full terms, appointed judges can run in yes/no retention elections for a shorter term.

The Missouri federal district courts are the United States District Court for Eastern District of Missouri, and the United States District Court for Western District of Missouri. Appeals from these districts are made to the U.S. Court of Appeals, 8th Circuit.

Missouri has two federal bankruptcy courts. These courts have subject-matter jurisdiction and can hear bankruptcy cases.

The Missouri Supreme Court was founded in 1820 and has seven judgeships.

The Missouri Supreme Court is the only court that can hear appeals regarding the validity or inapplicability of federal statutes and treaties, the validity or constitutional provisions of state statutes, state revenue laws, challenges or the right of a state elected official to hold office, or when the death penalty was imposed. The court can hear appeals at its discretion if there is a question of importance or generality, if the law needs to be re-examined, or if the lower court's decision conflicts with an earlier appellate ruling.

The Missouri Court of Appeals serves as the intermediate appellate court in the state of Missouri. Appeals from circuit courts are handled by the court of appeals. Missouri's appellate court system is split into the eastern, western, and southern districts.
