No one ever wants to have to hire a criminal defense attorney. I have had to twice in my life for two unrelated members of my extended family. The first was over 12 years ago. Had I not come across Mr. Dave Swanson, the results could have been devastating. I started my federal employment with ICE a component of DHS in 2005; and I was wrongfully terminated in 2006 because of discrimination and retaliation. I won the trial in EEOC court in 2008 against ICE for discrimination and wrongful termination. I was reinstated back to my job in late 2008. From late 2014 through 2017, ICE launched an unjust, discriminatory, selective, retaliatory, and malicious prosecution and adverse employment action against me. This was triggered by my former dishonest and corrupt supervisor after my whistleblowing about his illegal misconduct to both Office of Professional Responsibility of ICE and Office of Inspector General of DHS in June/July 2013. In retaliation for my civil actions, in December 2014 my employer ICE convinced a prosecutor in the Orange County District Attorney’s Office (OCDA) to file a felony charge against me after United States Attorney’s Office declined their request for prosecution. This was an unprecedented and unparalleled situation and the only case in history wherein there was a California state prosecution commenced due to a purported federal employment matter, and after the U.S Attorney rejected it!
After my first defense attorney did nothing, I then retained a CENTURY CITY Lawyer with a self-promotion profile website on the internet, which was a HUGE MISTAKE. He filed many motions, including motions to compel discovery in the Court of Appeal and the California State Supreme Court. Unfortunately, they ALL were unsuccessful and very costly with no benefit. He could never convince the prosecutor(s) of the validity of my defense. We had numerous hearings, and he could never convince the court of anything, and particularly the preliminary hearing judge. In in my opinion, he became completely defeated and telling me that, as a former prosecutor himself, my case was very difficult for us to win, but would be easy for the prosecution to prove. That’s when I decided I needed a real lawyer.
This time, rather than falling for exaggerated claims by lawyers on the internet, I came to Attorney David Swanson through a credible referral. After Attorney David Swanson took over the case, he worked tirelessly to conduct a thorough review and analysis of all the available evidence. He took the exact same evidence as my CENTURY CITY LAWYER and completely turned the case around. He and I worked as a team, which is his philosophy. He accepted and appreciated my input and analysis of the prosecution’s video evidence. That important evidence showed that my employer had fabricated the allegations against me. Attorney David Swanson also figured out there was exculpatory information in a separate report prepared by another government agency that we were able to obtain separately. As a result of Attorney David Swanson’s efforts, he convinced the prosecutor to request some additional evidence which was exculpatory and proved our position. Upon receiving this discovery and discussing it with Attorney David Swanson, the prosecutor agreed to completely DISMISS THE CASE. I believe OCDA realized that my employer DHS ICE was using them as their legal weapon to destroy me through particularly despicable racial profiling. The prosecution immediately filed a motion to dismiss, which was granted by the Court. In granting the motion, the judge who was very familiar with the case having presided over it for more than a year, expressed amazement Attorney David Swanson was able to get the case dismissed after witnessing the failures of my prior attorneys. This complete dismissal gives me the path for seeking justice and a remedy for the malicious prosecution. Through my experience with Attorney David Swanson, he has proved to be an extremely effective defense attorney with high competence with a brilliant legal mind, good moral character and loyalty to his clients.
