About the West Virginia Legal System

There are two federal courts in West Virginia: a state supreme and intermediate court of appeals and trial courts with limited and general jurisdiction.

The West Virginia Supreme Court of Appeals and West Virginia Intermediate Court of Appeals judges are chosen in the same way to serve 12-year, ten-year, and eight-year terms. The people elect them in nonpartisan elections. They must run for reelection when their terms end. Each judge of the West Virginia Family Courts is elected for a six- or eight-year term. The initial term of the judges is six years, and each subsequent term is eight. These elections are not contested and nonpartisan. Each judge of the West Virginia Magistrate Courts is elected for a four-year term. These elections are not contested and nonpartisan. The West Virginia Municipal Courts judges are chosen to serve a variety of terms, depending on where they reside.

The Federal District Courts in West Virginia include the Northern District and the Southern District.

The president nominates federal district court judges and they are confirmed by the United States Senate. These judges are appointed for life.

Two federal bankruptcy courts exist in West Virginia. These courts have jurisdiction over bankruptcy cases. The West Virginia federal bankruptcy courts are the Northern District of West Virginia bankruptcy judge and the Southern District of West Virginia bankruptcy court.

The court of last resort is the Supreme Court of Appeals. It can choose which cases from lower courts to be reviewed.

Circuit courts are West Virginia's main trial courts. They are responsible for most civil and criminal cases and hear appeals from lower courts. There are 31 judicial districts and 75 circuit judges.

West Virginia has 27 family court circuits with 47 judges. These courts deal with child custody and guardianship matters, as well as divorce.

The magistrate courts are courts with limited jurisdiction. West Virginia has 158 magistrates. They issue warrants, and protective orders, hear cases involving misdemeanors and minor civil cases, as well as conduct preliminary reviews.
