Paraquat MDL Location Selected

On June 7, 2021, the Judicial Panel on Multidistrict Litigation (JPML) formally selected a court and judge to hear the lawsuits of plaintiffs claiming that the herbicide paraquat caused a number of negative symptoms including Parkinson’s disease in a multidistrict litigation (MDL). This relocation of all cases in the developing paraquat MDL will allow all plaintiffs and defendants to be heard by the same judge.

The Syngenta Group and Chevron will be battling the dozens of plaintiffs in the U.S. District Court of Southern Illinois before Judge Nancy J. Rosenstengel. Judge Rosenstengel has not presided over an MDL before, but her district is currently hearing more than 20 cases regarding paraquat already.

Additionally, the JPML rationalized the District Court of Southern Illinois as a just location to hear the paraquat MDL since the state ranks in the top five for paraquat usage, and plaintiffs claim cases in the Southern Illinois court are the nearest to trial in terms of readiness. With the centralization of cases, plaintiffs and defendants will have an easier time gathering depositions and receiving rulings on the admissibility of evidence and experts.
