About the South Dakota Legal System

There is one federal court in South Dakota. A state supreme court and trial courts with limited and general jurisdiction are also available.

South Dakota's state court judges are selected through a combination of elections and appointments. Although they are all part of the state’s unified judiciary system, the magistrate, circuit, and supreme courts select their judges in different ways.

The United States District Court for South Dakota is South Dakota's federal district court. This court can hear appeals from state courts. It is also the origination point for federal cases or lawsuits. Appeals are made to the U.S. Court of Appeals, 8th Circuit.

The South Dakota Supreme Court was established in 1861 and includes five judgeships. The court decided on 375 cases in 2018.

South Dakota Circuit Courts are courts with general jurisdiction in South Dakota. There are 66 counties in South Dakota. Seven judicial circuits each have 44 judges.

South Dakota can be divided into three areas: the Black Hills, eastern South Dakota and western South Dakota. The Missouri River is a boundary that separates eastern and western South Dakota in terms of their political, geographical, and social differences. Native Americans have long held the Black Hills as sacred. However, the Black Hills' geography is so different from its surroundings that it can be considered distinct from the rest. Sometimes, the Black Hills is combined with other parts of western South Dakota. People often refer to these two regions as the West River or East River.

The eastern part of South Dakota has higher precipitation and more flat topography than its western counterpart. The Coteau des Prairies and Dissected Till plains are smaller geographic areas in this region. The Coteau des Prairies is a plateau that is bordered to the east and west by the Minnesota River Valley, and the James River Basin. The James River Basin, which follows the flow of South Dakota's James River from north to south, is a mostly flat, low-lying, heavily eroded area. The Dissected Till Plains is an area of fertile soil and rolling hills that extends into the southeast corner of South Dakota. It covers large parts of Iowa and Nebraska. Most of eastern South Dakota is covered by layers deposited in the Pleistocene Epoch. This epoch began around two million years back. These layers are among the youngest in the state. They are the result of multiple glaciations that deposited large amounts of soil and rocks over the region.
