I saw Matthew Kolken in 2014 for a free initial consultation. I was under threat of being deported due to my employer's improper actions. I repeatedly told Mr. Kolken that I was on a J-1 visa waiver, but the advice he gave was as if he thought I was merely on an H1 visa. It was as if he did not understand the J-1 visa program. At the meeting I actually knew more about the relevant J-1 immigration law than he did. I could not believe he was actually an immigration expert. He told me that my employer was required to pay for me to be transported back to my country, but other than that I had no case, no rights and I would just need to go back to where I came from. What he was saying reflected such a profound ignorance of J-1 visa waiver law that I actually started explaining the law to him. Despite my explanation, he continued to give the same ridiculous and worthless advice, concluding that I had no case and that I needed to prepare to leave my American family behind. He told me had a conflict of interest. He wanted to preserve a business relationship with my employer. I give him credit for being up front about that. However, he should have stopped right there, offering no advice. Instead he gave bad and incorrect advice. My impression is that he was not attempting to mislead me to protect my employer, which of course would be unethical. Rather he simply did not know the law. It is a good thing I did not believe him and saw other lawyers, with whom I successfully litigated my employer's actions. I was not deported and achieved a resolution that was satisfactory to me. I want to be fair. I really do not want to hurt Mr. Kolken's feelings, and do not want to hurt his reputation, but in reflecting on my past legal difficulties, I feel a duty to report my experience to warn others who might otherwise rely on him. Deportation cases of course can seriously affect people's lives. Please note that what I am reporting occurred in 2014. Maybe by now he has improved significantly.
