About the New York Legal System

New York has four federal district courts. A state court of appeals is also available. There are also trial courts with limited and general jurisdiction.

The New York Court of Appeals has seven justices who serve 14-year terms. The governor selects from a list of potential candidates, which is subject to confirmation by the New York Senate. The New York Supreme Court, Appellate Division has 60 justices. They serve for five years, or until the expiration of a supreme-court term, whichever comes first. A commission nominates them and the governor chooses from sitting supreme court judges. The New York Supreme Court's 324 justices are elected for 14-year terms through partisan elections. Candidates must be elected at partisan nomination conventions to appear on the ballot. The New York County Courts' 125 judges are chosen in the same way as the New York Supreme Court. Judges are elected for 10-year terms and must have a different set of qualifications.

The New York federal district courts are the Eastern District, the Northern District, the Southern District, the Southern District, and the Western District. The U.S. Court of Appeals, 2nd Circuit considers appeals from judgments and orders of this court.

The New York Court of Appeals serves as the court of last resort. The Court of Appeals is the highest court in New York. It hears civil and criminal appeals from both the supreme and appellate courts. This court may also hear appeals from state supreme courts.

Each of New York's 62 counties has its Supreme Court. These courts are New York's highest court of appeal and have general jurisdiction. They have jurisdiction over all civil and criminal matters. However, they are not able to decide on civil cases that are outside New York City. The criminal cases in each county are handled by the county courts. New York's Supreme Courts are not the courts of last resort. The highest court in New York is the Court of Appeals.

Each county has its own county court, with the exception of five counties that make up New York City. These 57 courts are responsible for all criminal cases that are filed in the county and civil lawsuits with an amount under $25,000.

New York is home to a diverse range of geography. The state's southeast part, known as Downstate, contains Long Island and several other smaller islands as well as New York City, and the lower Hudson River Valley. The larger Upstate New York region extends from Lake Champlain to Lake Champlain and has a border with Pennsylvania.
