On Dec. 13, the nation’s high court declined a review of an appeals court decision that ruled that the Department of Homeland Security (DHS) did not unlawfully violate the National Environmental Policy Act (NEPA) and ignore the environmental impact of the Deferred Action for Childhood Arrivals (DACA) program that was created in 2012 under the administration of former President Barack Obama.
DACA is an immigration policy that protects immigrants who were brought to the U.S. as children from deportation.
According to Reuters, groups who advocate for immigration control, such as Californians for Population Stabilization (CAPS), had petitioned the Supreme Court because of a ruling by the 9th U.S. Circuit Court of Appeals. That ruling upheld a lower court’s decision to dismiss allegations that the DHS violated NEPA.
In 2016, CAPS and other immigration control advocacy groups sued the federal government for failing to conduct the environmental impact of DACA that is required under NEPA.
In April 2021, Mark Brnovich, the Attorney General for Arizona, sued the DHS, arguing that changing immigration policies that were enacted under the Trump administration would harm the environment. The lawsuit, filed in a Phoenix federal court, is pending.
