In order to qualify for an EB5 visa, the applicant must invest in a company that was founded after November 29, 1990. There are some exceptions for older businesses if they are substantially restructured or reorganized to create a new commercial enterprise.
The investment must be considered "at risk," meaning there can be no guarantee of return on investment. This requirement ensures that investors are making genuine business investments rather than simply purchasing their way to permanent residency. The funds must remain invested throughout the conditional permanent residence period, typically lasting two years. During this time, the investor cannot withdraw or receive returns on their investment.
For standard investments, the minimum amount required is generally $1.05 million. TEAs are either rural areas that are outside a metropolitan statistical area or the outer boundary of any city or town having a population of 20,000 or more, or areas experiencing high unemployment (at least 150% of the national average unemployment rate).
The investment can take various forms, including cash, equipment, inventory, other tangible property, cash equivalents, and indebtedness secured by assets owned by the investor. Regardless of the source, the investor must be able to prove that the investment funds were obtained through lawful means. This can be demonstrated with proper documentation such as tax returns, business records, bank statements, investment accounts or documentation or property sales.Â
