Automotive Recalls: How They Affect Drivers

Any product recall can be scary. From dangerous food products to defective home appliances, a recall notice alerts consumers to a lurking threat hidden in their home—or garage. One of the most worrying notifications a consumer can receive is an automotive recall.

Automotive recalls are overseen by the National Highway Traffic Safety Administration (NHTSA). The NHTSA issues automotive recalls when a vehicle or vehicle part “creates an unreasonable safety risk or fails to meet minimum safety standards.”

There are several enforcement methods for automotive recalls. In the event of a recall, manufacturers must either:

  • Repair the faulty part
  • Replace the faulty part or vehicle
  • Offer a refund for the vehicle
  • Repurchase the vehicle from the consumer

These remedies will depend on the severity of the defect that caused the recall. These remedies may only come from the manufacturer. The dealer or secondhand seller is under no obligation to disclose or repair a product that is the subject of a recall.

A recalled part can cause injury to the driver, or it can cause an accident through no fault of the driver. If you have been involved in an auto accident because of a recalled defect, you need to call an auto accident attorney to ensure that you are being treated fairly by the police, your insurance company, and the other driver’s insurance.

An auto accident attorney can conduct an investigation on your behalf and collect vehicle data, including recall information, witness statements, and forensic evidence.
