Pharmacy error, or pharmacy malpractice refers to the practice of pharmacists acting in a manner that is contrary to their duty of care. Pharmacy error can refer to an incorrect filling of a prescription or to a failure to explain the side effects and interactions of a drug.

If a pharmacist has been negligent and breached their duty of care resulting in injury, then a lawsuit can be filed. It will be necessary to demonstrate that it was more likely than not that the duty of care was breached through reckless or negligent action that directly resulted in an injury.

According to the Academy of Managed Care Pharmacy, pharmacy errors can be reported by pharmacists or staff to the U.S. Food and Drug Administration (FDA), or the Institute of Safe Medication Practices. If a medication error is not reported, a lawsuit may be necessary to force accountability.
