Disability Insurance Claims May Be Wrongfully Denied

Many Americans purchase disability insurance to provide financial assistance in the event they become disabled and unable to work for a living. In most cases, disability insurance benefits cover between 40 and 60 percent of an individual’s gross income, depending on the policy. However, many legitimate disability claims are unfairly denied by the disability insurance companies, leaving policyholders without the benefits of a policy they have paid for.

Injured workers who have been denied Social Security Disability (SSD), Supplemental Security Income (SSI), or other types of disability insurance benefits may have a right to challenge the denial of benefits. Insurance companies may be in breach of contract or dealing in bad faith in the handling of the worker’s disability claim.

Denials of Social Security Benefits

Workers who have been disabled and are no longer able to work may qualify for federal assistance in the form of financial benefits called Social Security Disability Insurance (SSD) and/or Supplemental Security Income (SSI.

SSD pays benefits to the disabled worker and in some cases a worker’s relatives if the disabled worker has worked long enough and paid enough Social Security taxes. SSI is designed to help qualified aged, blind, and disabled workers who have little or no income by providing cash to provide for food, clothing, shelter, and other basic needs.

The government may challenge a party’s claim for SSD and SSI benefits by arguing that the injured party is not entitled to the benefits and is capable of working for a living. In such cases, a review of medical records and other documents may be necessary to establish a worker’s disabled status. Disability benefits may also be wrongfully delayed or terminated.
