Trasylol Lawsuits Filed in Illinois Circuit Court

Patients who say use of the drug Trasylol to control bleeding during heart bypass surgery caused them or their loved ones to suffer injuries or die have sued the drug’s maker for failing to warn of kidney damage, organ failure, and other potentially deadly side effects.

Three separate lawsuits were recently filed against Bayer in St. Clair County Circuit court, according to a report in the Madison-St. Clair Record. There are 55 plaintiffs named in the suits.

Trasylol was approved in 1993 by the Food and Drug Administration to prevent life-threatening bleeding during cardiac and bypass surgeries by helping the blood clot faster. Later, it was linked to renal toxicity, increased risks of heart attack and stroke, and other serious health complications.

Concerns about the risks associated with Trasylol prompted Bayer to pull the controversial drug from the market in 2007. More than four million patients were given Trasylol, which generated nearly $300 million in sales in 2005 alone, the lawsuits claim.

At least 10,000 Trasylol patients had to undergo dialysis treatment to treat complications from the drug.

The newly filed lawsuits accuse Bayer of failing to warn about the risks of side effects in patients treated with Trasylol, despite extensive medical research establishing a link as early as 2006.

In December 2006, the FDA ordered Bayer to revise Trasylol’s labeling to warn of the risks of kidney damage.

The plaintiffs now suing Bayer claim the use of Trasylol caused them to suffer pain and suffering, anxiety, distress, fear of death, and other damages. The lawsuits also seek reimbursement for medical bills, lost income and other out-of-pocket expenses linked to Trasylol.

The lawsuits allege defective design, strict product liability, intentional infliction of emotional distress, common law fraud, negligence, negligent misrepresentation, and wrongful death, according to the Record.

In June, two other lawsuits were filed in the same Illinois Circuit Court for Trasylol injuries.
